Top reasons why a Medispa would be investigated.

Medical facilities should avoid regulatory investigations at all costs, and knowing why these inquiries are typically initiated can help you to avoid them.

Improper Marketing:
There are many mistakes people can make while marketing that can get them involved with an investigation. Since these agencies are generally understaffed a lot of agents begin their investigations by doing internet searches for Medical Spas. terms like Medical Esthetician (which is not a real thing) or any indication that the ownership structure is not compliant might get you an agent at your door. you also might not want to advertise using testimonials with patients names, which would violate patient privacy laws. lastly if you advertise for example that you are the best Botox clinic in your area, you need to be able to back that up. you need to site skills that can be proven. 

No Exam:
If you are doing a procedure at a medical spa, it is most likely going to be medical in nature. It is best to conduct a face to face examination by the medical director or someone who has been delegated to do so by the physician, either an NP or PA.  A lot of practices think these minimally invasive treatments do not require an exam.  This is why it is of utmost importance to have your Protocols and Procedures in place in your office and signed by a medical director. 

Non-FDA Approved Drugs or Equipment:
Regulators are certain to come knocking at your door if they find that you have purchased pharmaceuticals from overseas, or out of the country. So many people have fallen prey to Canadian and Mexican Botox Purchases. The drugs are much cheaper, but almost everyone gets caught eventually. They will come to your office, they will search your products and take anything away that you have purchased, and worse shut you down.  Pharmaceutical companies are compelling the FDA to crack down these types of purchases even if the drugs are the same. 

Improper Oversight (Medical Director or Collaborator) not having the right type of oversight for your practice as a Nurse, NP, or a PA will get you investigated.


These agencies are generally overstaffed, so it is unlikely that you will be selected at random for an investigation, normally it begins with a competitor filing a complaint, so just remember that the more successful you become it is of utmost importance that you do things by the book.
